1. Acceptance of Terms

By creating an account, accessing, or participating in a FlashFrame space, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use the service.

We may update these terms from time to time to reflect changes in our service, legal requirements, or business practices. We will post the effective date at the top of this page. Your continued use of FlashFrame after any changes indicates your acceptance of the revised terms.

2. Who Can Use FlashFrame

You must be at least 18 years old and legally capable of entering into binding contracts to use FlashFrame. If you are using FlashFrame on behalf of a team, company, or other organization, you confirm that you have the authority to bind that entity to these terms.

By using FlashFrame, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and current.

AI Feature

3. AI and Machine Learning

FlashFrame may use artificial intelligence and machine learning technologies to enhance user experience, analyze ideas, provide suggestions, and improve the service. By using FlashFrame, you consent to the processing of your content by AI systems.

AI-powered features may include:

  • Idea enhancement and expansion suggestions
  • Automated categorization and tagging
  • Intelligent recommendations based on your activity
  • Content analysis to improve platform features
  • Similarity detection and duplicate prevention

Important: AI-generated outputs are provided "as-is" and should be reviewed and validated by users. FlashFrame does not guarantee the accuracy, completeness, or appropriateness of AI-generated content. You are responsible for reviewing and approving any AI suggestions before using them in your ideas or communications.

4. User-Generated Content

You retain ownership of all ideas, comments, files, and other content you create or upload to FlashFrame ("User Content"). FlashFrame does not claim ownership of your User Content.

By posting User Content, you grant FlashFrame a limited, worldwide, non-exclusive, royalty-free license to:

  • Host, store, and display your User Content within the service
  • Process your User Content to provide features like search, notifications, and AI enhancements
  • Make your User Content accessible to other members of spaces you've joined or created
  • Create backups and ensure service reliability

This license exists only to operate the service and ends when you delete your content or close your account (subject to backup retention periods outlined in our Privacy Policy).

You represent and warrant that you have all necessary rights to your User Content and that it does not violate any third-party rights or applicable laws.

5. Your Responsibilities

When using FlashFrame, you agree to:

  • Keep your login credentials secure and confidential
  • Notify us immediately if you suspect unauthorized access to your account
  • Only submit content you have the legal right to share
  • Ensure your content does not violate any laws, regulations, or third-party rights
  • Respect other space members and maintain a professional, constructive environment
  • Use the service only for lawful purposes
  • Comply with all applicable local, state, national, and international laws

You are responsible for all activity that occurs under your account. FlashFrame is not liable for any loss or damage arising from your failure to maintain account security.

6. Prohibited Uses

You may not use FlashFrame to:

  • Post illegal content: Content that violates laws or regulations, including but not limited to content that infringes intellectual property rights, defames others, or constitutes fraud
  • Send spam: Unsolicited advertising, promotional materials, or repetitive messages
  • Harass others: Threatening, abusive, hateful, or discriminatory content or behavior
  • Share malware: Viruses, trojans, or any malicious code designed to harm or exploit systems
  • Violate privacy: Sharing personal data of others without their consent
  • Reverse engineer: Attempting to decompile, disassemble, or reverse engineer any part of FlashFrame
  • Scrape or crawl: Using automated tools to extract data from FlashFrame without permission
  • Circumvent security: Attempting to bypass, disable, or interfere with security features
  • Impersonate: Pretending to be another person or entity
  • Interfere with service: Actions that disrupt, damage, or impair FlashFrame's functionality or other users' experience

Violation of these prohibitions may result in immediate termination of your account and legal action where appropriate.

7. Intellectual Property

FlashFrame and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of FlashFrame and its licensors. This includes but is not limited to software, designs, text, graphics, logos, icons, images, and audio clips.

The FlashFrame service is protected by copyright, trademark, and other laws of Australia and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

8. Termination

Your right to terminate: You may close your account at any time through your account settings or by contacting us at hello@flashframe.app.

Our right to terminate: We may suspend or terminate your access to FlashFrame immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms & Conditions
  • Violation of applicable laws or regulations
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Request by law enforcement or government agencies

Upon termination, your right to use the service will immediately cease. We will make reasonable efforts to provide you access to export your data within 30 days of termination, unless prohibited by law or if your account was terminated due to violations.

9. Service Changes

FlashFrame is an evolving product. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, including:

  • Adding, removing, or modifying features
  • Imposing limits on storage, users, or usage
  • Changing pricing or subscription models
  • Discontinuing the service entirely

We will make reasonable efforts to provide advance notice of significant changes, including notice via email or in-product notifications. However, we are not obligated to do so and will not be liable for any modifications, suspensions, or discontinuations.

10. Limitation of Liability

FlashFrame is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, FlashFrame and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Service interruptions or errors
  • Unauthorized access to or alteration of your content
  • Statements or conduct of any third party on the service
  • Any other matter relating to the service

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law. In any case, our total liability to you for all damages shall not exceed the amount you paid us (if any) in the six months prior to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless FlashFrame, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms & Conditions
  • Your use or misuse of the service
  • Your User Content or any content you post or share
  • Your violation of any third-party rights, including intellectual property rights
  • Your violation of any applicable laws or regulations

12. Dispute Resolution

Informal resolution: If you have any dispute with FlashFrame, you agree to first contact us at hello@flashframe.app and attempt to resolve the dispute informally. We will work in good faith to reach a mutually satisfactory resolution.

Binding arbitration: If we cannot resolve a dispute informally within 60 days, both parties agree to resolve disputes through binding arbitration in accordance with the laws of Australia, except that either party may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

Class action waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and FlashFrame individually. To the fullest extent permitted by law, no arbitration or proceeding shall be joined with any other, and there is no right or authority for any dispute to be arbitrated on a class-action basis.

13. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect.

14. Severability

If any provision of these Terms & Conditions is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

In such cases, the parties agree to work in good faith to replace the invalid provision with a valid provision that most closely approximates the intent and economic effect of the invalid provision.

15. Entire Agreement

These Terms & Conditions, together with our Privacy Policy and any other legal notices or agreements published by FlashFrame, constitute the entire agreement between you and FlashFrame concerning your use of the service.

These Terms supersede and replace any prior agreements, understandings, or representations, whether written or oral, regarding the subject matter herein. No amendment to these Terms shall be effective unless made in writing and signed by an authorized representative of FlashFrame.
